Change List Type of ui_list

Is there anyway of changing the list type of a ui_list on the fly, or remove the menu button from items without menu options?

The reason why is that I have a dynamically generated list of items that display a menu for users to choose from, however sometimes that list is empty for a period of time, so I show a "Nothing here yet" item, but the menu option still appears. My users are not clever people and they keep trying to click it.

I know, it's a technical solution to training issue :smiley:
